General Terms & Conditions – BEAUTIFUL BAG
October 2006

1. By placing an order with BEAUTIFUL BAG, you accept the general terms and conditions relating to the sale and purchase of items. Deviations to these terms and conditions are solely applicable if provided in writing, in which case the remaining terms and conditions remain in full force and effect.

BEAUTIFUL BAG retains the right to change the terms and conditions without prior written notification.

2. Prices for products and services are in Euro, are including Value Added Taxes (VAT or BTW), but are excluding handling and shipping costs, and taxes or other levies unless agreed in writing.

3. BEAUTIFUL BAG reserves the explicit right to adjust the prices, in particular when such is necessary on the basis of legal or other regulatory requirements.

4. Orders are possible exclusively by means of the Internet site www.beautiful-bag.com or by means of recognized resellers. An agreement only comes in full force and effect after a BEAUTIFUL BAG accepts your order and confirms such in writing.

BEAUTIFUL BAG has the legal right to refuse orders or impose certain conditions to the provision of the order goods and services, unless otherwise explicitly stipulated.

If an order not be accepted, BEAUTIFUL BAG will issue a notification within ten (10) working days after receiving the purchase order.

5. Production and delivery of products and services will only start after 100% of the payment has been received. As soon as payment of the full invoice amount has been received by BEAUTIFUL BAG, BEAUTIFUL BAG will proceed processing the order.

Payment can be made as defined in the order process. Additional payment, order, delivery or other terms and conditions may be placed on your order.

When payment for products and services is made through bank or Giro, then the payment date is considered to be that date upon which the bank or Giro account of BEAUTIFUL BAG is credited.

Cancelation of the order will be followed up with a voucher of the amount of the order. Refund can occur minus 10% of the amount of the order.

6. Shipment and delivery of products and services take place both domestically as well as internationally. Shipping charges are to be borne by the buyer and are to be fully paid in advance.

7. The prices of the product, as mentioned on the Internet site, are binding for BEAUTIFUL BAG for the buyers purchase order at that point in time.

8. BEAUTIFUL BAG aims to achieve a delivery time of 8 weeks from the date upon which the design delivered by BEAUTIFUL BAG has been approved. BEAUTIFUL BAG cannot be held liable if products and services are not delivered after 8 weeks. Delivery times provided by BEAUTIFUL BAG are only indicative.
Non-delivery of products and services within the defined 8 week timeframe does not provide the buyer to claim any sort of damages nor does it provide the buyer the right to cancel the order or cancel the purchase agreement, unless overshooting the delivery deadline is such that the buyer cannot be reasonably expected to maintain the agreement. In such case, the buyer can cancel the order or cancel the agreement insofar this is necessary.

Shipment and/or delivery of products and services is completed when the products and services are ready for shipment to the buyer.

9. Ownership of the delivered products is transferred to the buyer only when all obligations as defined in the agreement with BEAUTIFUL BAG have been fully fulfilled. The buyer accepts the risk relating to the products at the moment of the delivery.

10. The buyer is to inspect the products and services upon delivery and verify if the products and services meet the agreed specifications. If this is not the case, the buyer needs to inform BEAUTIFUL BAG no later than seven (7) days from delivery of the products and services, or at least after observation was reasonably possible, in writing (by e-mail) and by including sufficient detail.
If sufficient evidence has been provided to show that the products and services do not comply with the agreed specifications as defined in the agreement between the buyer and BEAUTIFUL BAG, then BEAUTIFUL BAG has the option to replace the said products and services once they have been returned by the buyer with either new products or by refunding the buyer for the invoice amount of the returned goods.

11. Any questions relating to the products and services purchased from BEAUTIFUL BAG should be submitted through email (… email address…).

12. Minor deviations in color, cropping or finishing of the products and services delivered by BEAUTIFUL BAG are possible and do not constitute faulty products.

13.BEAUTIFUL BAG assumes no responsibility for damage or loss of photograph(s) supplied by the buyers for printing of a BEAUTIFUL BAG. If one or more of the delivered photographs are copyrighted in any way, it is the obligation of the buyer to obtain approval or authorization from the owner. BEAUTIFUL BAG assumes at any and all times that the photograph(s) are owned by the buyer or that the buyer has obtained authorization or approval from the original owner.

14. Beautiful bags cannot be resold or copied without written authorization by BEAUTIFUL BAG.

15. BEAUTIFUL BAG disclaims any liability or responsibility for any misunderstanding, miscommunication, delays in or damage to shipments that may result from the use of BEAUTIFUL BAG products and services and the Internet or any other means of communication between the buyer and BEAUTIFUL BAG or between third parties and BEAUTIFUL BAG as far as they relate to the agreement between the buyer and BEAUTIFUL BAG.

In the worse case BEAUTIFUL BAG will produce a new, similar product. No refunds will be paid.

16. Notwithstanding other rights, farce majeure, or for events beyond the control of BEAUTIFUL BAG, BEAUTIFUL BAG retains the right to cancel the order of the buyer, or cancel the agreement with the buyer without involvement from other legal parties, as long as the buyer is notified in writing and as long as BEAUTIFUL BAG is not entitled to any further compensation, unless reasonable and fair circumstances dictate otherwise.

Farce majeure is defined as but not limited to any event beyond the control of BEAUTIFUL BAG or for which BEAUTIFUL BAG is not to blame by law, legal regulations or otherwise.

17. If the buyer informs BEAUTIFUL BAG in writing of his or her address, it is BEAUTIFUL BAGs legal right to ship all orders to this address, unless the buyer notifies BEAUTIFUL BAG in writing of a change of address to which the orders have to be sent.

18. The products of BEAUTIFUL BAG are made according to the latest trends in colors. For this reason, it might be that the final color of (some parts of) the product differ from the image and/or texts on the website.

19. Guarantee
Should the product show a design, material or construction flaw, the buyer has the right to a repair or replacement of the purchased product. The buyer only has right to replacement should repair of the product not be possible and only if the buyer notifies Beautiful Bag within 6 months from the date of purchase. Purchased goods that require repair or that need to be replaced need to be sent to Beautiful Bag with sufficient postage. Beautiful Bag will become the owner of such. Warranty is voided on Beautiful Bag products when damage results from improper use.
